Terms of Service

  The short version: Called It is a social prediction game. No real money. No gambling. Cred is virtual and worthless (in the best way). Be a decent person to your friends. Don't post anything awful.

These Terms of Service ("Terms") govern your use of the Called It mobile application ("the App") and website at calledit.one ("the Website"), operated by Even Kildal ("the Operator", "we", "us", "our").

By creating an account or using Called It, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Called It
If you are under 18 and in a jurisdiction where parental consent is required, you must have your parent or guardian's permission
By creating an account, you represent that you meet these requirements

2. Your Account

You are responsible for maintaining the security of your account
You are responsible for all activity that occurs under your account
Use accurate information when creating your account
One account per person — do not create multiple accounts
If you believe your account has been compromised, contact us immediately at hello@calledit.one

3. Virtual Currency (Cred)

  This is critical: Cred is a virtual, in-app currency with absolutely no real-world monetary value. Called It is NOT gambling.

Cred is a virtual point system used exclusively within Called It for entertainment purposes
Cred has no monetary value whatsoever
Cred cannot be purchased with real money (Cred is earned through gameplay and monthly refills)
Cred cannot be exchanged, sold, traded, transferred, or converted to real currency, cryptocurrency, or any item of real-world value
Cred cannot be withdrawn, cashed out, or redeemed for real money or prizes
We may adjust, reset, or modify Cred balances at our discretion to maintain gameplay balance
If your account is deleted, all Cred is permanently lost with no compensation
Cred balances do not constitute a personal property right

Called It is a social prediction game — not a sportsbook, casino, or gambling service. No real-money wagering occurs on the platform. "Bets" and "voting" in the App refer to virtual predictions using Cred, not financial transactions.

4. User-Generated Content

4.1 Your content

You are responsible for all content you create in Called It, including bet questions, group names, and any other text you post ("User Content"). By posting User Content, you grant us a non-exclusive, royalty-free, worldwide license to display your content within the App to other users as part of the service's functionality.

4.2 Content rules

You agree NOT to post content that:

Is illegal, threatening, abusive, harassing, or defamatory
Promotes violence, hatred, or discrimination against any person or group
Contains sexually explicit or pornographic material
Targets, bullies, or harasses a specific individual (within or outside the App)
Contains personal or private information about someone without their consent
Infringes on any third party's intellectual property rights
Is spam, phishing, or commercial solicitation
Attempts to manipulate, exploit, or abuse the App's systems

4.3 Content moderation

Users can report inappropriate content using the report function available on all bets and suggestions
We review reported content and may remove it and/or suspend accounts at our sole discretion
We are not obligated to monitor all User Content, but we reserve the right to do so
Repeated violations will result in permanent account suspension

5. Acceptable Use

You agree not to:

Use the App for any illegal purpose
Attempt to access another user's account
Use bots, scripts, or automated tools to interact with the App
Reverse engineer, decompile, or disassemble any part of the App
Attempt to manipulate leaderboards, prediction scores, or Cred balances through fraudulent means
Create bets designed to bully, harass, or target specific individuals
Use the App to facilitate real-money gambling between users
Circumvent any security measures or access controls
Use the App in any way that could damage, disable, or impair the service

6. Subscriptions and Payments

6.1 Called It Pro

Called It offers an optional premium subscription ("Called It Pro") with additional features. Pro subscriptions are available as:

Monthly: $4.99 USD per month
Annual: $29.99 USD per year

Prices may vary by region and are displayed in your local currency at the time of purchase.

6.2 Billing

Subscriptions are processed and billed through Apple's App Store or Google Play Store, depending on your device
Payment is charged to your Apple ID or Google account at confirmation of purchase
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date
Your account will be charged for renewal within 24 hours prior to the end of the current period

6.3 Cancellation

You can cancel your subscription at any time through your device's subscription settings (Apple: Settings → Apple ID → Subscriptions; Android: Play Store → Subscriptions)
Cancellation takes effect at the end of the current billing period — you retain Pro access until then
We do not offer refunds for partial subscription periods
Refund requests should be directed to Apple or Google, as they process all payments

6.4 Price changes

We may change subscription prices. If we do, we will notify you in advance and give you the option to cancel before the new price takes effect. Continued subscription after a price change constitutes acceptance of the new price.

6.5 Restore purchases

If you reinstall the App or switch devices, you can restore your active subscription using the "Restore Purchases" option in the App.

7. AI Features

Called It uses artificial intelligence (Anthropic's Claude API) to generate bet suggestions ("AI Shit-Stirrer"). Regarding AI-generated content:

AI suggestions are generated for entertainment purposes only
AI suggestions are based on your group's activity and are not personal advice
We are not responsible for the content of AI-generated suggestions, though we implement content safety filters
Users can report inappropriate AI suggestions using the report function
AI-generated content may occasionally be inaccurate, inappropriate, or irrelevant despite our safety measures

8. Intellectual Property

Called It, its design, logo, features, and code are owned by the Operator and protected by applicable intellectual property laws
You may not copy, modify, distribute, or create derivative works based on Called It without our written permission
You retain ownership of your User Content, subject to the license granted in Section 4.1
"Called It", the Called It logo, and "Cred" are trademarks of the Operator

9. Disclaimers

9.1 Service provided "as is"

Called It is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We do not guarantee that:

The App will be available at all times or without interruption
The App will be free of errors or bugs
Any specific results will be achieved from using the App
Data will never be lost (though we implement reasonable backups)

9.2 Not gambling

Called It is a social entertainment application. It is not a gambling service. No real money, cryptocurrency, or items of value are wagered, won, or lost through the App. The Operator does not facilitate, promote, or condone real-money gambling between users.

9.3 User interactions

We are not responsible for the behavior, content, or actions of other users. Your interactions with other users through the App are at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

The Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
Our total liability for any claim related to the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater
This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise)

11. Account Termination

11.1 By you

You can delete your account at any time through Settings → Delete Account in the App. Account deletion:

Permanently removes your profile, predictions, votes, and all associated data within 30 days
Is irreversible — deleted data cannot be recovered
Does not automatically cancel active subscriptions — cancel your subscription separately before deleting
Results in forfeiture of all Cred (which has no monetary value)

11.2 By us

We may suspend or terminate your account if you:

Violate these Terms
Post content that violates our content rules (Section 4.2)
Use the App in ways that harm other users or the service
Create multiple accounts or engage in fraudulent activity

We will make reasonable efforts to notify you before or at the time of suspension, except in cases of severe violations where immediate action is warranted.

12. Indemnification

You agree to indemnify and hold harmless the Operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

Your use of the App
Your User Content
Your violation of these Terms
Your violation of any third party's rights

13. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Norway
Any disputes shall first be attempted to be resolved through good-faith negotiation
If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Norway
Nothing in this section prevents you from filing a complaint with your local consumer protection authority

14. Changes to These Terms

We may modify these Terms at any time. When we do:

We will update the "Last updated" date at the top
For material changes, we will notify you via in-app notification or email at least 14 days before the changes take effect
Continued use of Called It after changes take effect constitutes acceptance
If you disagree with changes, you may delete your account before they take effect

15. General Provisions

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Operator regarding Called It
No waiver: Our failure to enforce any right or provision does not constitute a waiver of that right
Assignment: You may not transfer your rights under these Terms. We may assign our rights and obligations without restriction
